LICENSED APPLICATION END USER LICENSE AGREEMENT

1. Acceptance of Terms

Welcome to Star Chess! These Terms of Service ("Terms") govern your use of the Star Chess mobile application ("App," "we," "our," or "us"). By downloading, installing, or using the App, you agree to be bound by these Terms.

2. License Grant

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to download, install, and use the App for your personal, non-commercial use on a device that you own or control.

You May:

• Install and use the App on devices you own or control
• Play chess games against AI or other players on the same device
• Save and replay your games
• Customize game settings and preferences

You May Not:

• Copy, modify, or create derivative works of the App
• Reverse engineer, decompile, or disassemble the App
• Rent, lease, lend, sell, redistribute, or sublicense the App
• Remove, alter, or obscure any proprietary notices on the App
• Use the App for any commercial purpose without our written permission
• Attempt to gain unauthorized access to any portion of the App

3. User Responsibilities

When using Star Chess, you agree to:

• Use the App in compliance with all applicable laws and regulations
• Not use the App in any way that could harm, disable, overburden, or impair the App
• Not interfere with any other user's use and enjoyment of the App
• Not attempt to circumvent any security features of the App
• Ensure your device meets the minimum system requirements for the App
• Keep your device's operating system updated for security and compatibility

4. Intellectual Property Rights

The App, including all content, features, functionality, graphics, user interface, and the software used to implement the App, is owned by Star Chess, its licensors, or other providers of such material and is protected by copyright, trademark, patent, trade secret, and other intellectual property laws.

Trademarks

"Star Chess" and related graphics, logos, and service names are trademarks of Star Chess. You may not use these trademarks without our prior written permission.

Your Content

You retain all rights to any content you create within the App (such as saved games and custom settings). This content is stored locally on your device and is not transmitted to us. By using the App, you grant yourself the right to use, modify, and delete this content as you see fit.

5. Game Rules and Fair Play

Star Chess follows standard international chess rules. While the App is designed for fair play:

• The AI opponent uses algorithmic decision-making and does not cheat
• Game outcomes are determined by chess rules and player moves
• We do not guarantee any particular level of AI performance
• Users are expected to play in good faith and not exploit bugs or glitches

6. App Updates and Modifications

We reserve the right to modify, suspend, or discontinue the App (or any part thereof) at any time, with or without notice. We may also:

• Release updates, patches, and new versions of the App
• Add or remove features and functionality
• Require you to update the App to continue using it
• Change these Terms from time to time

We will notify you of material changes to these Terms through the App or via the email address associated with your Apple ID (if available through the App Store).

7. Third-Party Services

The App is distributed through the Apple App Store and uses Apple's native frameworks (SwiftUI, SwiftData, SceneKit). Your use of these services is subject to:

• Apple's Terms and Conditions
• Apple's Privacy Policy
• Any other applicable Apple policies

We are not responsible for any third-party services, and your use of such services is at your own risk.

8. Disclaimers and Limitation of Liability

No Warranty

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that:

• The App will be uninterrupted, secure, or error-free
• Any defects or errors will be corrected
• The App will be compatible with all devices or operating systems
• The results obtained from using the App will be accurate or reliable

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, IN NO EVENT SHALL STAR CHESS, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE APP.

IN NO EVENT SHALL OUR TOTAL LIABILITY TO YOU EXCEED THE AMOUNT YOU PAID FOR THE APP (WHICH IS CURRENTLY ZERO, AS THE APP IS FREE).

9. Indemnification

You agree to indemnify, defend, and hold harmless Star Chess and its officers, directors, employees, agents, and licensors from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

• Your use or misuse of the App
• Your violation of these Terms
• Your violation of any rights of another person or entity
• Any content you create or store using the App

10. Termination

These Terms are effective until terminated by either you or us.

Termination by You

You may terminate these Terms at any time by:

• Deleting the App from all your devices
• Ceasing all use of the App

Termination by Us

We may terminate or suspend your access to the App immediately, without prior notice or liability, if:

• You breach these Terms
• We are required to do so by law
• We discontinue the App

Effect of Termination

Upon termination:

• Your license to use the App will immediately cease
• You must delete the App from all your devices
• Any provisions that should survive termination will continue to apply

11. Governing Law and Dispute Resolution

Governing Law

These Terms shall be governed by and construed in accordance with the laws of [Your Jurisdiction], without regard to its conflict of law provisions.

Dispute Resolution

In the event of any dispute arising out of or relating to these Terms or your use of the App:

1. Informal Resolution: We encourage you to contact us first to seek an informal resolution

You and Star Chess agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.

12. General Provisions

Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Star Chess regarding the App and supersede all prior agreements and understandings.

Severability

If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights.

Assignment

You may not assign or transfer these Terms or your rights under these Terms without our prior written consent. We may assign these Terms without restriction.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, war, terrorism, riots, natural disasters, or failures of telecommunications or internet infrastructure.

Language

These Terms are written in English. Any translated versions are provided for convenience only. In the event of any conflict between the English version and a translated version, the English version shall prevail.

13. Apple-Specific Terms

If you are using the App on an iOS device, the following additional terms apply:

• These Terms are between you and Star Chess only, not with Apple Inc. ("Apple")
• Apple has no obligation to provide any maintenance or support services for the App
• In the event of any failure of the App to conform to any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) to you. To the maximum extent permitted by law, Apple will have no other warranty obligation with respect to the App
• Apple is not responsible for addressing any claims you have or any claims of any third party relating to the App
• Apple is not responsible for the investigation, defense, settlement, and discharge of any third-party intellectual property infringement claim
• You represent and warrant that you are not located in a country subject to a U.S. Government embargo or designated as a "terrorist supporting" country
• Apple and Apple's subsidiaries are third-party beneficiaries of these Terms, and upon your acceptance of these Terms, Apple will have the right to enforce these Terms against you

14. Changes to These Terms

We reserve the right to modify these Terms at any time. When we do, we will:

• Update the "Last Updated" date at the top of this page
• Post the updated Terms on our website
• Notify you through the App or other reasonable means for material changes

Your continued use of the App after any changes constitutes your acceptance of the new Terms. If you do not agree to the updated Terms, you must stop using the App.
